Legal, Disclaimer & Acceptable Use Policy

Lightbeam Digital Group (Pty) Ltd · Website Policy · South Africa

Effective Date: 2 September 2026 · Version 1.0

1. Introduction

This Legal, Disclaimer & Acceptable Use Policy governs access to and use of Lightbeam Digital Group (Pty) Ltd (“Lightbeam Digital”, “we”, “us” or “our”) websites, online portals, digital resources and electronic communications, except where a separate written agreement expressly applies.

2. Acceptance and Scope

By accessing our website or using publicly available resources, you agree to use them lawfully and responsibly. Contracted services remain subject to the applicable quotation, statement of work, service-level agreement, master services agreement and other contractual documents.

3. Website Information

We endeavour to keep website information accurate and current. However, technical specifications, service descriptions, pricing, availability, security information and other content may change without notice. Website content is provided for general information and does not constitute a binding offer unless expressly stated otherwise.

4. IT and Cybersecurity Disclaimer

Cybersecurity is a risk-management discipline rather than a guarantee of immunity from attack. Managed security, SOC monitoring, endpoint protection, email security, firewalling, vulnerability management, backups, incident response and related controls can reduce exposure but cannot guarantee that systems will never be compromised, unavailable, infected, exploited or subject to data loss.

Threat intelligence, security advisories, vulnerability information and technical guidance published by Lightbeam Digital are provided for informational and operational purposes. Users must validate applicability within their own environments and obtain appropriate professional advice where necessary.

5. Authorised Security Testing

No penetration testing, vulnerability scanning, credential testing, social engineering, exploitation, reverse engineering or other security activity may be conducted against systems, networks, applications or accounts without appropriate authorisation. Lightbeam Digital may refuse or suspend activity where scope, ownership or authorisation cannot be reasonably established.

6. Acceptable Use

Users must not use our websites, portals, systems or services to conduct unlawful, fraudulent, malicious or abusive activity. Prohibited activity includes:

  • Unauthorised access
  • Malware distribution
  • Credential theft
  • Phishing
  • Unauthorised interception
  • Disruption or denial-of-service activity
  • Unauthorised scanning or exploitation
  • Infringement of intellectual property
  • Harassment
  • Distribution of unlawful content
  • Attempts to bypass security controls
  • Use of our infrastructure to facilitate attacks against third parties

7. Security and Access Credentials

Users are responsible for safeguarding credentials, tokens, authentication devices and other access mechanisms assigned to them. Credentials must not be shared except where expressly authorised. Suspected compromise must be reported promptly through the applicable support or security channel.

8. Email Communications Disclaimer

Email communications from Lightbeam Digital may contain confidential, privileged or commercially sensitive information and may be intended only for the named recipient. If you received an email in error, do not use, copy, disclose or distribute it and notify the sender. Although reasonable security controls may be applied, email is not inherently risk-free and Lightbeam Digital cannot guarantee that an email or attachment is free from interception, alteration, malware or other security threats.

Where an attachment or link has been released from a security hold or filtering control at a user's request, the recipient remains responsible for exercising appropriate caution and verifying the legitimacy of the sender, message and content before opening or executing it.

9. Mobile and Portable Device Communications

Messages sent from mobile devices may contain automatically generated signatures, shortened formatting or transmission metadata. Mobile delivery does not alter the confidentiality, legal or security status of the communication. The sender’s availability or ability to respond may be affected by connectivity, device or service limitations.

10. Intellectual Property

Unless otherwise stated, website content, branding, text, graphics, documents, software, methodologies and other materials are owned by or licensed to Lightbeam Digital and may not be reproduced, modified, distributed or commercially exploited without permission. Third-party trademarks remain the property of their respective owners.

11. Third-Party Services

Lightbeam Digital may integrate with or refer to third-party products and services, including cloud platforms, security tools, connectivity providers and technology vendors. Third-party services are subject to their own terms and policies. Unless expressly agreed, Lightbeam Digital does not warrant the availability, security or performance of third-party services.

12. Availability and Changes

We do not guarantee that the website or any online resource will be continuously available, uninterrupted, error-free or free of vulnerabilities. We may modify, suspend or discontinue website functionality, content or access at any time.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Lightbeam Digital will not be liable for indirect, incidental, consequential, special or punitive losses arising from website access, reliance on published information, third-party services, communications, cyber incidents or events outside our reasonable control. Nothing in this policy excludes liability that cannot lawfully be excluded or limited.

14. Indemnity

To the extent permitted by law, a user who unlawfully uses our website, systems or services or breaches this policy may be responsible for losses, claims, costs or expenses arising from that conduct. Contractual indemnities in a signed client agreement will take precedence where applicable.

15. Confidentiality

Information exchanged through contracted services may be subject to confidentiality obligations contained in the applicable agreement. Website publication of a document does not authorise disclosure of confidential client information or security-sensitive information.

16. External Links

Links to external websites are provided for convenience or reference. Lightbeam Digital does not control third-party websites and is not responsible for their content, availability, security or privacy practices.

17. Governing Law

Unless a separate written agreement provides otherwise, this policy is governed by the laws of the Republic of South Africa. Disputes will be subject to the jurisdiction of the applicable South African courts.

18. Policy Changes

We may update this policy periodically. The version published on the website with the latest effective date constitutes the current version for website users.
